Terms of Service
Last updated 19 August 2026. By creating a WAFlow account you agree to these terms.
1. Agreement
These terms form a binding agreement between you (or the business you represent) and WAFlow for use of the platform at https://wafollow.in. If you do not agree, do not use the service.
2. Accounts
You must be at least 18 and authorised to bind your business. You are responsible for the accuracy of your account details, for keeping credentials and API keys confidential, and for all activity in your workspace. Notify us immediately at security@wafollow.in if you suspect unauthorised access.
3. Your WhatsApp Business Account
WAFlow is a Meta Business Solution Provider integrating the official WhatsApp Business Cloud API. You connect your own Meta Business portfolio and WhatsApp Business Account through Meta Embedded Signup and you remain their owner. Your use of WhatsApp is additionally governed by Meta's WhatsApp Business Terms, the WhatsApp Business Messaging Policy, and Meta's Commerce Policies. If Meta suspends or restricts your account, WAFlow cannot override that decision.
4. Acceptable use
You agree not to use WAFlow to:
- message people who have not given prior opt-in consent to receive WhatsApp messages from you;
- send spam, bulk unsolicited promotions, or purchased or scraped contact lists;
- send content that is unlawful, deceptive, fraudulent, hateful, harassing, sexually explicit, or that infringes third-party rights;
- promote products or services prohibited by Meta's Commerce Policy, including illegal drugs, weapons, or unapproved financial and gambling offers;
- impersonate another business or person, or misrepresent your identity as the message sender;
- ignore opt-out ("STOP") requests, or remove or obscure unsubscribe instructions;
- reverse engineer, resell, or exceed the rate limits of the platform or its API, or bypass usage limits;
- upload malware, probe our infrastructure without authorisation, or interfere with other customers' use.
We may suspend a workspace immediately for a serious or repeated breach, or where Meta requires it. Where practical we will warn you first and give you a chance to fix the issue.
5. Consent and your responsibility as sender
You are the sender of every message. You are responsible for lawful opt-in, honest sender identity, honouring opt-outs promptly, keeping records of consent, and complying with applicable law including GDPR, the DPDP Act, TCPA/CASL-style rules where relevant, and consumer protection law.
6. Fees and billing
Subscription fees are shown on the pricing page and billed in advance monthly or annually. Fees exclude taxes unless stated. WhatsApp conversation charges are set and billed by Meta and are separate from your WAFlow subscription. Payments are non-refundable except where required by law or where we cancel the service without cause. Failure to pay may result in suspension after notice.
7. Trials
Trials are provided as-is for evaluation and may be limited or withdrawn. At the end of a trial your workspace becomes read-only unless you subscribe.
8. Your data
You own your contact and message data. We process it on your behalf as described in the privacy policy. You can export it at any time and request deletion via data deletion. We may use aggregated, de-identified statistics to improve the service.
9. Availability and support
We aim for high availability but do not guarantee uninterrupted service on standard plans; maintenance windows and third-party outages (including Meta's) can affect delivery. Support response targets are described on the support page. Enterprise plans may include a written SLA.
10. Third-party services
The platform depends on third parties such as Meta, our hosting provider, our payment processor, and optional AI providers. Their terms apply to their portions of the service and we are not liable for their acts or omissions.
11. Intellectual property
WAFlow and its software, design, and trademarks remain ours. You receive a non-exclusive, non-transferable right to use the platform during your subscription. "WhatsApp", "Meta", and "Facebook" are trademarks of Meta Platforms, Inc.; WAFlow is not affiliated with or endorsed by Meta beyond its status as a solution provider integrating the official API.
12. Warranties and disclaimer
The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant specific delivery rates, template approvals, or business results, all of which depend on Meta and on your own practices.
13. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Our total aggregate liability is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability that cannot lawfully be limited.
14. Indemnity
You will indemnify WAFlow against third-party claims arising from your messages, your content, your lack of consent, or your breach of these terms or of Meta's policies.
15. Termination
You may cancel at any time from Billing; access continues to the end of the paid period. We may terminate for material breach, non-payment, or legal necessity. On termination we delete or anonymise your workspace data within 30 days, subject to legal retention.
16. Changes
We may update these terms. Material changes will be posted here and notified to account owners at least 14 days in advance. Continued use after the effective date is acceptance.
17. Governing law
These terms are governed by the laws of India, and the courts of Delhi have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
